Experiment Submission Terms

These Experiment Submission Terms apply when you submit an experiment, recipe, formula, tasting result, review, photograph, video or other material to Wine Rebels Adventure Lab through our website, email or another submission channel.

The website is operated by Nadine Lee Gaffney ABN 44 327 987 415, a sole trader trading as Wine Rebels Adventure Lab (“Wine Rebels”, “we”, “us” or “our”).

By submitting material, you agree to these Terms and our:

If you do not agree, please do not submit material.

1. Who may submit an experiment

You may submit material only if:

  • you are at least 18 years old;
  • you have reached the legal drinking age in the country, state or location where you participate;
  • you have legal capacity to agree to these Terms; and
  • your participation and submission comply with the laws applying in your location.

If your local legal drinking age is higher than 18, the higher age applies.

You must not submit an experiment prepared for, involving or encouraging alcohol consumption by anyone below the applicable legal drinking age.

2. Responsible and voluntary participation

Participation in a Wine Rebels experiment is voluntary. You are responsible for deciding whether an experiment is lawful, safe and suitable for you and anyone participating with you.

You agree to:

  • use sensible tasting quantities;
  • account for all alcoholic ingredients used;
  • check labels, alcohol content, allergens, intolerances and dietary restrictions;
  • consider relevant medications and health conditions;
  • use food-safe ingredients, equipment, preparation and storage methods;
  • never pressure another person to consume alcohol;
  • never provide alcohol to an underage person;
  • never drive, operate machinery or undertake another dangerous activity after drinking; and
  • stop an experiment if anything appears unsafe or a participant becomes unwell.

3. Experimental nature and assumption of responsibility

Wine Rebels experiments may involve unusual combinations, substitutions and preparation methods. Results can vary depending on quantities, brands, equipment, preparation, storage, personal taste, health and other circumstances.

By submitting an experiment, you acknowledge that:

  • experimenting with alcoholic drinks carries inherent risks;
  • combining wine, spirits and liqueurs may create a stronger drink than expected;
  • Wine Rebels did not supervise your experiment unless we expressly state otherwise;
  • your submission may not have been independently tested or verified; and
  • a submission, rating or publication does not amount to professional safety certification.

You remain responsible for your own preparation, participation and decision to consume or serve an experiment.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

4. What you may submit

A submission may include:

  • the experiment name or title;
  • ingredients and quantities;
  • preparation instructions;
  • equipment used;
  • tasting observations;
  • ratings, scores and verdicts;
  • modifications or suggested improvements;
  • safety or allergen information;
  • a story or description;
  • photographs or videos, where separately authorised; and
  • your chosen contributor name or credit.

Please provide enough detail for us to understand and, if appropriate, recreate or evaluate the experiment.

5. Your promises about the submission

You confirm that, to the best of your knowledge:

  • the information you provide is honest and reasonably accurate;
  • you created the submission or have the necessary authority to submit it;
  • the submission does not infringe another person’s copyright, trademark, privacy, confidentiality or other rights;
  • you have not copied substantial protected content from another recipe, publication, website, video or creator;
  • you have identified any source, inspiration or adaptation that should reasonably be disclosed;
  • any branded product references reflect ingredients actually used and do not falsely imply sponsorship;
  • the submission does not contain unlawful, defamatory, discriminatory, threatening, obscene or deliberately harmful material;
  • the submission does not contain undisclosed advertising, paid promotion or affiliate content;
  • you have not included another person’s personal information without appropriate permission; and
  • every identifiable person appearing in submitted media has given the permission described in section 10.

You must tell us promptly if you later discover a material error, safety issue or rights concern involving your submission.

6. Ownership of your material

You retain any copyright or other intellectual-property rights you hold in your original submission.

Submitting material does not transfer ownership of your copyright to Wine Rebels. Instead, you grant us the limited licence described below.

Ideas, ingredient combinations, facts and basic methods may not themselves be protected by copyright. These Terms do not promise that every element of an experiment can be owned or kept exclusive.

7. Licence for experiment content

For the written and non-media parts of your submission, you grant Wine Rebels a worldwide, non-exclusive, royalty-free licence to:

  • receive, store and review the submission;
  • test and recreate the experiment;
  • edit, correct, format, adapt and combine its content;
  • reproduce, publish and communicate it on the Wine Rebels website;
  • include it in Lab Reports, the Recipe Vault, Experiments, Disaster Files and Lab Journal content;
  • display it through Wine Rebels social-media accounts and newsletters;
  • archive it and retain reasonable records of its submission and publication; and
  • permit contractors and service providers to undertake these activities on our behalf.

This licence applies only to material you have submitted for these purposes. It does not give us ownership of your copyright.

The licence continues while the submission is used or retained for the purposes above, subject to your withdrawal rights in section 14.

Any use in a product offered for sale, paid advertising campaign, merchandise, licensed game or unrelated commercial partnership requires your additional permission unless we have separately agreed otherwise with you.

8. Editing and testing

You authorise us to:

  • correct spelling, grammar, formatting and obvious errors;
  • standardise ingredient names, measurements and presentation;
  • clarify instructions;
  • adjust quantities for testing, serving size or safety;
  • substitute ingredients during testing;
  • add editorial comments, warnings, classifications or ratings;
  • shorten the submission for website or social-media presentation; and
  • create a revised Wine Rebels version based on our testing.

We will not knowingly edit your submission in a way that falsely represents your experience or unfairly harms your reputation.

Our published version may differ from your original submission. Where changes are substantial, we may describe the published item as adapted from, inspired by or tested from your submission.

9. Moral rights

To the extent permitted by law, you consent to Wine Rebels carrying out the editing, formatting, adaptation, combination, cropping and publication activities expressly described in these Terms, even where an activity might otherwise affect your moral rights.

This consent does not permit us to falsely attribute someone else’s work to you or subject your work to derogatory treatment outside the activities reasonably contemplated by these Terms.

Australian copyright law recognises moral rights and provides for an author’s consent to specified acts or omissions. This section therefore describes the permitted treatment rather than requiring a blanket waiver of all moral rights. Copyright Act 1968 (Cth)

10. Photographs and videos

Submitting an experiment does not automatically authorise us to publish its photographs or videos.

If you separately agree to photograph/video publication, you grant Wine Rebels a worldwide, non-exclusive, royalty-free licence to:

  • store, review, reproduce and publish the authorised media;
  • crop, resize, caption, colour-correct and format it;
  • include it with the relevant Lab Report or other Wine Rebels editorial content;
  • display it on the Wine Rebels website, newsletters and social-media accounts; and
  • credit it using your approved name or leave it uncredited according to your selected preference.

Prominent paid advertising, product packaging, merchandise, a commercial game or third-party commercial licensing will require additional permission unless separately agreed with you.

Before submitting identifiable images, you must have permission from every identifiable person appearing in them, including permission for the uses described above. Do not submit images of anyone under 18.

Photographs and videos in which a person can reasonably be identified may constitute personal information. Separate, informed media permission provides a clearer record of the authorised use. OAIC guidance on posting photos and videos

11. Contributor name and credit

You may request publication under:

  • your full name;
  • a first name;
  • an approved display name or nickname; or
  • “Anonymous Researcher” or equivalent anonymous wording.

We will take reasonable care to follow the selected credit preference, but cannot guarantee that attribution will appear with every shortened, shared or reformatted use.

If another person substantially contributed to the submission, you must have their permission before naming or crediting them.

Credit does not establish employment, partnership, agency, endorsement or ownership by Wine Rebels.

12. No guaranteed publication or certification

Submitting material does not guarantee:

  • acceptance or publication;
  • testing within a particular time;
  • a particular rating, status or classification;
  • certification or approval;
  • contributor credit in every use;
  • feedback or correspondence;
  • payment, prizes, royalties or other compensation; or
  • continued publication.

We may publish an experiment as successful, still under testing, untested, adapted or unsuccessful—including in the Disaster Files—according to our editorial assessment.

A Wine Rebels stamp, label, rating or classification is an editorial description only. It is not a professional food-safety or health certification.

13. Moderation and removal

We may decline, delay, edit, restrict, unpublish or remove a submission where we reasonably believe it:

  • is unsafe, unlawful or irresponsible;
  • contains materially inaccurate or incomplete information;
  • infringes another person’s rights;
  • contains personal information without appropriate authority;
  • creates a privacy, legal, safety or reputational concern;
  • contains spam or undisclosed promotion;
  • breaches these Terms or the Website Terms of Use; or
  • is unsuitable for Wine Rebels.

Where practical, we may contact you for clarification before publishing or materially changing a submission, but we are not required to do so.

14. Withdrawing permission

You may ask us to stop future publication or use of your submission by contacting us through our Contact the Lab page.

We will consider the request promptly and take reasonable steps appropriate to the circumstances. Withdrawal will generally affect future use after we process the request.

Withdrawal may not require us to:

  • retrieve printed or downloaded copies already distributed;
  • remove third-party reposts outside our control;
  • erase lawful business, consent, moderation or legal records;
  • undo completed uses that were authorised when made; or
  • remove material we are legally required or entitled to retain.

If you withdraw permission for identifiable media, we will not rely on the withdrawn consent for new uses. The OAIC advises that withdrawing consent should be accessible and that withdrawal ordinarily affects future use or disclosure. OAIC consent guidance

15. Privacy

We may collect information such as your name, email address, location, age declaration, experiment details, IP or technical information, correspondence and any authorised photographs or videos.

We use this information to:

  • receive and manage submissions;
  • contact you about your experiment;
  • test, moderate and publish authorised content;
  • maintain consent and publication records;
  • investigate complaints or safety concerns;
  • protect the website and enforce these Terms; and
  • comply with legal obligations.

Our Privacy Policy explains how we collect, use, disclose, store and protect personal information and how you may request access or correction.

Do not include unnecessary health details, identification documents, home addresses or another person’s private information in your experiment notes.

16. Marketing communications

Submitting an experiment does not subscribe you to marketing communications.

Any newsletter or promotional consent must be optional and separate from the permissions required to process your submission.

You may still receive non-marketing messages reasonably necessary to manage, clarify, test or publish your submission.

Keeping marketing consent separate avoids bundled consent and allows contributors to submit without subscribing. OAIC consent guidance

17. Complaints and rights concerns

If you believe a submission:

  • infringes your intellectual-property rights;
  • uses your image or personal information without permission;
  • incorrectly attributes material to you;
  • contains unsafe information; or
  • is otherwise unlawful or inappropriate,

please contact us through our Contact the Lab page and provide enough information for us to investigate.

We may temporarily restrict material while reviewing a complaint.

18. Liability and rights that cannot be excluded

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including any applicable rights under the Australian Consumer Law.

To the maximum extent permitted by law, you are responsible for:

  • your participation in and preparation of an experiment;
  • the truth and legality of your submission;
  • obtaining necessary permissions from contributors and people appearing in media; and
  • foreseeable loss directly caused by your material breach of these Terms or infringement of another person’s rights.

You are not responsible for loss caused by Wine Rebels’ own conduct or for loss that could not reasonably have been avoided.

These provisions are intended to allocate responsibility fairly and must not be interpreted as a blanket exclusion of legal rights. Australian law prohibits proposing or relying on unfair terms in applicable standard-form consumer and small-business contracts. ACCC contract guidance

19. Changes to these Terms

We may update these Terms when our submission process, publishing activities or legal obligations change.

The current version will be published on this page with its last-updated date. The version accepted when you submit material will ordinarily apply to that submission.

If we want to use existing material for a materially broader purpose not covered by the accepted version—such as commercial product packaging or third-party advertising—we will seek additional permission where required.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

Subject to any legal right to bring a claim elsewhere, the courts and tribunals of New South Wales and courts hearing appeals from them have non-exclusive jurisdiction.
