Website Terms of Use
These Website Terms of Use govern your access to and use of the Wine Rebels Adventure Lab website at winerebelslab.com, including its recipes, Lab Reports, interactive experiment tools, articles, images, videos, forms and other content.
The website is operated by Nadine Lee Gaffney (ABN 44 327 987 415), trading as Wine Rebels Adventure Lab (“Wine Rebels”, “we”, “us” or “our”).
By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.
1. Adults only
This website contains alcohol-related content and is intended only for people who:
- are at least 18 years old; and
- have reached the legal drinking age in the country, state or location where they access the website or participate in an experiment.
If the legal drinking age where you are located is higher than 18, the higher age applies.
You must not use this website to encourage, facilitate or promote underage drinking or supply alcohol to anyone below the applicable legal drinking age.
Our age gateway helps communicate these restrictions but does not independently verify your age. You are responsible for providing truthful information and complying with the laws that apply in your location.
2. Purpose of the website
Wine Rebels Adventure Lab provides alcohol-related entertainment, general information, experimental drink ideas and a place for adults to share wine experiments.
The website may include:
- wine-based recipes and experimental formulas;
- Lab Reports and ratings;
- tested, untested and user-submitted experiments;
- unsuccessful experiments and Disaster Files;
- interactive ingredient-selection tools;
- articles and general educational content;
- photographs, videos and social-media content;
- newsletter and contact forms; and
- opportunities to submit experiments, comments, ratings or other material.
The website does not currently sell or supply alcohol.
3. Responsible use and safety
You must use the website and any experiment responsibly.
Before preparing, tasting or serving an experiment, you are responsible for:
- checking that every ingredient is lawful, safe and suitable;
- checking alcohol content, allergens, dietary restrictions, medication interactions and health considerations;
- following product labels, storage instructions and use-by dates;
- using clean, food-safe equipment and appropriate preparation methods;
- controlling serving and tasting quantities;
- complying with applicable alcohol, food-safety and other laws;
- ensuring that alcohol is not supplied to an underage person; and
- ensuring that no participant drives or undertakes a dangerous activity after drinking.
You must not consume or serve an experiment if you are uncertain about its ingredients, preparation, condition or safety.
Our Responsible Drinking & Safety Notice forms part of these Terms and should be read before participating in an experiment.
4. Experimental and user-submitted content
Wine Rebels is built around experimentation. Some content may therefore be:
- untested or incompletely tested;
- submitted by members of the public;
- based on personal tastes and individual experiences;
- modified from an earlier version;
- affected by differences between ingredient brands or quantities; or
- published as an example of an unsuccessful or unusual experiment.
A Wine Rebels rating, status, stamp, label, category or description—including terms such as “tested”, “approved”, “certified”, “successful” or “recommended”—describes our assessment or editorial classification only.
It is not a professional safety certification, medical assessment, food-safety guarantee or assurance that an experiment will be safe, suitable or enjoyable for every person.
Results may vary. You must use your own judgement and independently assess whether an experiment is appropriate for you and anyone to whom you serve it.
5. No professional advice
The website provides entertainment and general information only.
Nothing on the website constitutes medical, health, dietary, nutritional, food-safety, legal, financial or other professional advice.
You should obtain advice from an appropriately qualified professional where necessary, including before consuming alcohol if you have concerns involving medication, pregnancy, breastfeeding, allergies, intolerances, health conditions or alcohol dependency.
6. Permitted use
Subject to these Terms, you may:
- browse and use the website for personal, lawful and non-commercial purposes;
- prepare an experiment for private use, subject to all applicable laws and safety precautions;
- print or save a reasonable number of recipes or Lab Reports for personal use;
- share a link to a publicly available Wine Rebels page; and
- submit material through our forms in accordance with the applicable submission terms.
Any permission granted under these Terms is limited, revocable, non-exclusive and non-transferable.
7. Prohibited use
You must not:
- use the website for an unlawful, fraudulent or harmful purpose;
- use it to promote irresponsible, excessive or underage drinking;
- misrepresent your age, identity or connection with Wine Rebels;
- copy, reproduce, republish, sell or commercially exploit substantial website content without permission;
- remove copyright, trademark or attribution notices;
- represent Wine Rebels content as your own;
- use our brand, content or experiments to advertise or endorse a product or business without written permission;
- scrape, harvest or systematically extract website content or data;
- use automated systems to access the website in a way that burdens or disrupts it;
- introduce malware, malicious code or other harmful material;
- attempt to bypass security, access restrictions or age controls;
- interfere with the website, server, forms or another user’s access;
- collect another person’s personal information without authority;
- submit content that is false, misleading, defamatory, discriminatory, abusive, obscene, infringing or unlawful; or
- encourage conduct that may cause injury, property damage or legal harm.
8. Intellectual property
Unless otherwise stated, the website and its original content are owned by or licensed to Wine Rebels. This includes:
- the Wine Rebels Adventure Lab name and branding;
- logos, graphics, illustrations and design elements;
- original photographs and videos;
- written content, Lab Report formats and editorial material;
- website layouts, selection systems and interactive features; and
- compilations, classifications and arrangements of content.
These materials are protected by copyright, trademark and other intellectual-property laws.
Nothing in these Terms transfers ownership of our intellectual property to you.
You must obtain our written permission before using Wine Rebels content for commercial publication, merchandise, marketing, another website, a commercial event, a paid product or another business purpose.
Any third-party names, trademarks, products or content remain the property of their respective owners. Reference to a third-party product does not necessarily indicate sponsorship, endorsement or commercial association.
9. User submissions
If you submit an experiment, recipe, review, photograph, video, story, comment or other material, additional Experiment Submission Terms will apply.
Those terms will explain:
- what you confirm about your submitted material;
- the rights you retain;
- the permission you give us to review, edit, reproduce and publish it;
- how contributors may be credited;
- when photographs or videos may be used; and
- when we may decline, remove or retain a submission.
Submission of material does not guarantee publication, testing, certification, payment, attribution or any other benefit.
Until the Experiment Submission Terms and required consent fields are active, new experiment submissions should not be published publicly.
10. Accuracy and availability
We take reasonable care when preparing and managing the website, but we do not promise that:
- every item of content is complete, accurate or current;
- every experiment will produce the described result;
- the website will always be available, secure or free from errors;
- links and interactive features will always function;
- submissions will be received, retained, reviewed or published; or
- errors will always be corrected immediately.
We may correct, update, suspend, restrict or remove any part of the website without notice.
Where practical, we welcome reports of potentially unsafe recipes, incorrect information and technical problems through our Contact the Lab page.
11. Third-party links and services
The website may link to third-party websites, social networks, products, plugins or services.
Third parties operate under their own terms, privacy practices and security arrangements. Unless expressly stated, we do not control or endorse them and are not responsible for their content, availability, conduct or practices.
You access third-party services at your own discretion.
12. Privacy and cookies
Our collection and handling of personal information is explained in our Privacy Policy.
The website may also use cookies and similar technologies for security, functionality, analytics, form processing, saved preferences and other disclosed purposes. Further information will be provided in our Cookie Notice.
By submitting personal information, you confirm that the information is accurate and that you are authorised to provide it.
Where you provide another identifiable person’s information or image, you must have their permission unless another lawful basis applies.
13. Liability and rights that cannot be excluded
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
To the maximum extent permitted by law:
- you are responsible for how you use website content and for assessing whether an experiment is appropriate for you;
- we are not responsible for loss or harm caused by ingredients, quantities, substitutions, preparation methods, storage, misuse, unlawful conduct or failure to follow warnings;
- we are not responsible for user-submitted statements or material merely because they appear on the website; and
- we are not liable for indirect or consequential loss arising from use of, or inability to use, the website where that liability may lawfully be excluded.
Nothing in this section limits liability for fraud, wilful misconduct or any other liability that the law does not permit us to limit.
Australian consumer guarantees are automatic and cannot be removed by website terms. This is why these Terms use “to the maximum extent permitted by law” rather than claiming that all liability is excluded. Australian Competition and Consumer Commission guidance
14. Responsibility for breaches
To the extent permitted by law, you are responsible for reasonably foreseeable loss or damage that we suffer as a direct result of:
- your unlawful use of the website;
- your material breach of these Terms;
- content you submit without the necessary rights or permissions; or
- your infringement of another person’s rights.
This section does not make you responsible for loss caused by our own conduct or for loss that could not reasonably have been avoided.
15. Moderation and restriction of access
We may reject, edit, restrict or remove submissions or other material where we reasonably believe it:
- breaches these Terms or the Experiment Submission Terms;
- creates a legal, safety, privacy or reputational risk;
- infringes another person’s rights;
- contains spam, malicious material or undisclosed advertising;
- promotes unsafe or irresponsible conduct; or
- is unsuitable for the website.
We may suspend or restrict access to website features where reasonably necessary to protect users, the website, our rights or another person’s rights.
16. Changes to these Terms
We may update these Terms when the website, our practices or applicable laws change.
The latest version will be published on this page with its effective or last-updated date. Changes apply from the date they are published unless a later date is stated.
If a change materially affects how an existing submission or personal information may be used, we will take any additional steps required by law.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
Subject to any rights you have to bring a claim elsewhere under applicable consumer law, the courts and tribunals of New South Wales and any courts hearing appeals from them have non-exclusive jurisdiction in relation to these Terms.
18. Severability
If part of these Terms is found to be invalid or unenforceable, it will be read down to the minimum extent necessary or, if that is not possible, severed. The remaining provisions will continue to operate.
19. No waiver
If we do not immediately enforce a right under these Terms, that does not mean we waive that right.
20. Contact
Questions, complaints, safety concerns and copyright matters may be submitted through our Contact the Lab page or sent to:
